In these cases the issue is not validity of guidelines and the issue is whether such guideline will have retrospective effect. I find that in this case before the Hon'ble High Court of Madras, it was the case of the department that the standing order is not binding but only in the nature of guidelines to streamline the functioning of the customs offices. If that is the situation, unless it is shown that there was something wrong with the assessment or the impugned orders, just because the assessing officers followed certain norms for arriving at the quantity, they cannot be found fault with so long as the same is not perverse or illogical.
