Thus, the excess credit of Rs.94,62,626/- was liable to be recovered as per Rule 57I of erstwhile Central Excise Rules, 1944 read with Section 11A of the Central Excise Act, 1944. This was taken on appeal by the Revenue before the Commissioner of Central Excise (Appeals).
