(AR) Per: Mathew John: The appellant is a unit of National Textile Corporation Ltd. which is a public sector undertaking. The appellant had filed Appeal No.E /607/2005 before the Tribunal, aggrieved by an impugned order. As per the directions of the Apex Court prevailing at the relevant time, the appellant had to produce a clearance from the Committee of Secretaries on Disputes between Government and PSU for pursuing remedy before appellate Tribunal. Since no such clearance was produced, the appeal was dismissed by this Tribunal vide Final Order No.953 /2006 dated 12.10.2006. 2. Now the appellant has filed this restoration application relying on the decision of the Apex Court in the case of Electronics Corporation of India Vs. Union of India - 2011 (265) ELT 11 (SC), wherein the Apex Court directed that the practice be discontinued. 3. The prayer in the restoration application is that now that the Apex Court has decided that COD clearance is not required, the appeal already dismissed should be restored and decided. 4. The issue whether appeals which were already considered by the Committee on Disputes and a decision taken not to allow either side to pursue further appellate remedies, the matter can be reopened in the light of the decision in the case of Electronics Corporation of India (supra), was decided by the Larger Bench of the Tribunal in Burn Standard Co. Ltd. Vs. CCE - 2012 (286) ELT 125 (Tri.- LB). Since the matter is no longer res integra, I follow the decision of the Larger Bench of the Tribunal and dismiss this ROA application.
