....heir statements stated that -   (1) the appellant company were registered with Service Tax Department since 17-7-1997 for "Consulting Engineers' Service" and initially, while in respect of their contract (SYS-I) with DMRC, they had paid service tax amounting to Rs. 33,60,883, thereafter in view of Hon'ble Supreme Court's decision in case of Daelim Industrial Co. Ltd. v. Ltd. (supra), Larsen & Toubro Ltd. (supra) and Petrofac International Ltd. ....73(1) of the Finance Act, 1994 is available to the Department for recovery of service tax which was payable but was not paid by the appellant?   7.1 Though the appellant had service tax registration and initially they were paying service tax on the amount received from DMRC in respect of the taxable service provided to DMRC in course of execution of this contract, without giving any intimation to the Department, they subsequently stopped paying service tax in respect of this contract and even stopped declaring in their ST-3 returns, the amounts received from DMRC for jobs covered by the definition of 'Consulting Engineer's Service' and 'Erection, Installation or Commissioning Service'.
