The only issue which arose for consideration was whether the capital loss incurred by the assessee on redemption of units of mutual funds was liable for disallowance in view of the provisions of section 94(7) of the Income-tax Act, 1961 (hereinafter referred to as "the Act"). 2. The assessee being aggrieved by the order passed by the Assessing Officer carried the matter in appeal to the Commissioner of Income-tax (Appeals) (hereinafter referred to as "the CIT(A)").
