....s Tax) Act attempts to include within its ambit and declares such transaction as sale of goods it is doing so contrary to the definition of sale of goods to be found in the Sale of Goods Act. For reasons stated in Dukhineswar Sarkar's case[1957] 8 S.T.C. 478. this cannot be allowed and the provisions of law contained in section 2(4) of the Act is to that extent ultra vires.
