From the foregoing it appears that the question of imposition of cost for not issuing show cause notice to M/s. Raziya Timber Industries does not arise as it would be contrary to the position held by the Apex Court in the case of CCE v. V. Madhu [2002 (146) E.L.T. 252 (S.C.).
