....were stuffed at the exporter's premises at Manuru, Udupi under the supervision of the jurisdictional officers of Central Excise. The containers for stuffing actually were sent from Cochin port. At the time of stuffing the containers, three sets of samples were drawn for examination. Two sets of samples were duly sealed and handed over to the exporter for submitting them to Customs at the port of export. The third sample was retained by the Central Excise officers at Udupi. After stuffing, the containers were sealed by the Central Excise officers and sent to Cochin Port for further export. ....e fact of cross examination has been refused for frivolous reasons and this itself is a pointer to the fact that the case of the department that goods other than silk fabric was exported cannot stand the test of law. 5. The learned SDR reiterated the findings of the Commissioner in the impugned order. 6. We have gone through the records of the case carefully.
