....without excise duty which is less than the custom duty. In case M/s. Royal Industries Ltd. 50% of the raw material was indigenous and in the case of M/s. Punjab Exports Ltd. 87% of the raw material was procured locally. The contention is that in respect of this raw material the demand is confirmed after taking into consideration the Custom Duty, which is higher than the Central Excise duty. The applicant also pleaded that they are entitled for the benefit of Notification No. 2/95-C.E. in respect of demand of duty, which provides the concessional rate of duty @ 50% of the whole of the customs duty.
