The entirety of the facts and evaluation of reasons recoded reveal that there could not be any prima facie satisfaction of the Assessing Officer for coming to conclusion that there has been escapement of income by the appellant more particularly when the appellant had not started any business operation even in the succeeding year i.e., assessment 1994-95 and whole of the expenses incurred were treated as capital work in progress.
