....esent case, cannot be imposed as the Rule 96ZO itself provides for a penalty. Therefore, following Government of India's decision in the case of Sahib Sing Manufacturing Co. (P) Ltd. [1978 (2) E.L.T. (J460)] wherein it was held that penalty under Rule 173Q was not correct in law since contravention of Rule 226 was punishable, thereunder, I do not find a case for imposition of penalty under Rule 17....
