He submits that since the main use was that of Fungi, therefore, the additional benefit available therein could not disqualify the products from being classified as Fungicides. 6. The learned Counsel also submits that the brand name used by them was in the use ever since they have commenced their manufacturing activity for a long time after the technology transfer from their parent Company in Germany.
