The statement of Watchman was clearly not believable because the Watchman was prejudiced witness. He used to get salary/remuneration from the appellants and subsequently, the remuneration was discontinued. The Watchman clearly felt offended and was prejudiced against the appellants. Furthermore, he was attending to his duties only during night whereas the factories were taking production during day time. It is clearly established that the Watchman's statement cannot be considered as the conclusive evidence.
