The above facts narrated by the learned Consultant are not disputed by the Departmental Representative Shri Naik. 5. We heard the elaborate arguments from both the sides. 5.1. After considering the arguments from both the sides, the undisputed factual position is that no sample of blended yarn for this sort has been subjected to chemical test but all the proceedings are only on the basis of test of fabrics. From the technical opinion furnished from the Head of the Department of Textile Chemistry of Bombay University, we are satisfied that there are bound to be variations in the blend composition, when fabrics are tested. ....stify the demand for extended period, especially when the fibre content of yarn declared is marginal one, where such yarn should have been subjected to test on declaration in classification list for the first time. Hence, apart from consideration of the merits of the appellants arguments on technical possibility of variation of fibre content, we are fully satisfied that there is no wilful mis-declaration with an intention to evade duty, justifying extended period for demanding duty.
