As such, it is seen that the principle laid down therein was not correctly appreciated by the first appellate authority. 9. Similarly, in the case of Rakesh Aggarwal. Their Lordships, relying upon the case of Apogee International Ltd. have held that the intimation under section 143(1)(a) of the Income-tax Act, 1961 even after issue of notice under section 143(2) does not oust the jurisdiction of the Assessing Officer to issue a fresh notice under section 143(2), where he considers it to be necessary or expedient to ensure that the assessee has declared his income correctly.
