      Summary: The Central Board of Indirect Taxes & Customs, under section 14(2) of the Customs Act, substitutes Tables 1-3 in the principal notification to prescribe tariff values in US dollars per metric tonne or per unit for specified commodities: edible oils (various palm and soybean oils), brass scrap, poppy seeds, areca nut, and specified forms of gold and silver, including explanatory provisions and exclusions for certain import modes.

      Bihar Goods and Services Tax (Seventh Removal of Difficulties) Order, 2019
      Summary: The Order substitutes the Explanation to section 44 of the Bihar GST Act, 2017 to change the due date for furnishing the annual return electronically for registered persons (with specified exclusions) for the period 1 July 2017 to 31 March 2018, in order to address technical problems that prevented timely filing and to remove the resulting difficulty under section 172.

      Extension of Due date for FORM GSTR-3B for July, 2019.

The notification is deemed issued on 20th August, 2019.

      Jharkhand Goods and Services Tax (Sixth Removal of Difficulties) Order, 2019
      Summary: The Order substitutes the Explanation to section 44, extending the electronic annual return filing cutoff from 30th June, 2019 to 31st August, 2019 to address technical problems that prevented submission for the period 1 July 2017 to 31 March 2018, and applies to registered persons covered by section 44(1) except specified excluded categories; the Order is effective from 28th June, 2019.

      Seeks to extend the due date for furnishing FORM GSTR-3B for the month of July, 2019.
      Summary: The Commissioner prescribes that FORM GSTR-3B for July 2019 be filed electronically through the common portal on or before 22nd August 2019 generally, with a district-specific extension permitting taxpayers whose principal place of business is in Kolhapur, Sangli, Satara, Ratnagiri, Sindhudurg, Palghar, Nashik or Ahmednagar to file on or before 20th September 2019; the notification takes effect from 20th August 2019.

      Seeks to extend the date from which the facility of blocking and unblocking of e-way bill facility as per the provision of Rule 138E of MGST Rules, 2017 shall be brought into force to 21.11.2019.
      Summary: The Finance Department of Maharashtra, by Notification No.36/2019 State Tax, amends an earlier state notification to defer the commencement of the blocking and unblocking of e way bill facility under Rule 138E of the MGST Rules, 2017, substituting the earlier prescribed date with a later date and thereby postponing the implementation of that mechanism.

The return was required to be filed electronically through the common portal on or before 22 August 2019, and a further extension applied to registered persons whose principal place of business was in the districts of Uttarkashi and Chamoli, for whom the due date was extended to 20 September 2019.       Seeks to amend Notification No. 430/2019/03 (120)/XXVII(8)/2019/CT-21, dated the 31st May, 2019
      Summary: The Government of Uttarakhand issued a further amendment under section 148 of the Uttarakhand Goods and Services Tax Act, 2017 to modify an earlier GST notification dated 31 May 2019. In paragraph 2 of the said notification, the proviso is amended by substituting 31 July 2019 with 31 August 2019, thereby extending the relevant time limit contained in the existing notification.

      Seeks to amend Notification No. 530/2017/9(120)/XXVII(8)/2017 Dated 29 June, 2017
      Summary: Exemption under the Uttarakhand Goods and Services Tax law is extended by amending the existing notification in public interest. A new entry covers supply to a local authority of an electrically operated vehicle meant to carry more than twelve passengers, and the explanation defines electrically operated vehicles as vehicles under Chapter 87 of the Customs Tariff Act, 1975 that run solely on electrical energy from an external source or fitted batteries. The amendment is made under section 11(1) on the recommendation of the Council and takes effect from 1 August 2019.

      Seeks to amend Notification No. 514/2017/9 (120)/XXVII(8)/2017 Dated 29 June, 2017
      Summary: Amends the Uttarakhand State GST rate notification by inserting a 2.5% entry in Schedule I for chargers or charging stations for electrically operated vehicles and by inserting an entry for electrically operated vehicles, including two- and three-wheeled electric vehicles, with an explanation defining such vehicles and including e-bicycles. It also omits a specified entry from Schedule II and amends Schedule III to exclude chargers or charging stations for electrically operated vehicles from the entry relating to inductors, with effect from 1 August 2019.

      West Bengal Goods and Services Tax (Seventh Removal of Difficulties) Order, 2019
      Summary: The Order amends the Explanation to section 44 of the West Bengal GST Act to extend the prescribed deadline for furnishing the annual return, invoked under section 172 to remove difficulties caused by technical problems, thereby permitting registered persons who could not file electronically for the affected period to submit the annual return by the substituted later date.

      Summary: The circular directs taxpayers to report ITC and reversals precisely in GSTR-3B Table 4: total eligible ITC including amounts to be reversed in 4(A); reversals under rule 42/43 in 4(B)(1) and reversals under rule 37 or other reversals in 4(B)(2); net available ITC in 4(C) as 4(A) less 4(B); and ineligible or blocked credits in 4(D) distinguishing section 17(5) items in 4(D)(1) and section 17(4)/rule 38 and other ineligible credits in 4(D)(2).

      Documents required to be uploaded for grant of Registration.
      Summary: The circular deletes the prior requirement to upload a licence for licensed commodities as part of the documents for all types of registration. The condition that a licence showing the licensee's name, licence period, signature, stamp and seal be uploaded is withdrawn and the change applies henceforth. The circular is clarificatory only and traders with doubts are directed to seek further clarification from the issuing office.

      Corrigendum to Circular No. 97/16/2019-GST dated 8th April, 2019 issued vide No. GSL/GST/S.168/B.37, as amended vide Corrigendum dated 02.07.2019.
      Summary: Eligible registered persons opting for the composition levy must file FORM GST CMP-02 as specified under sub rule (3) of rule 3 by selecting "Any other supplier eligible for composition levy" and must furnish a statement in FORM GST ITC-03 in accordance with sub rule (3) of rule 3. The corrigendum extends the deadline for filing the CMP-02 intimation and related ITC-03 compliance and allows reporting of implementation difficulties to the Chief Commissioner of State Tax; the corrigendum is deemed issued on the stated effective date.

      Issues related to GST on monthly subscription/ contribution charged by a Residential Welfare Association from its members.
      Summary: Supply of services or goods by an unincorporated RWA or non-profit entity to its own members for common use is exempt from GST where the contribution or reimbursement does not exceed the prescribed per-member monthly limit; if the RWA's annual aggregate turnover does not exceed the registration threshold it need not register or pay GST even if charges exceed the per-member limit, but where turnover meets or exceeds the threshold and per-member charges exceed the ceiling the entire amount charged is taxable. RWAs may claim input tax credit on inputs, capital goods and input services used to provide supplies to members, and the per-member ceiling applies separately to each residential unit owned.
