      Amendment in Notification No. FA3-07-2021-1 -V-(26), dated the 10th June, 2021
      Summary: The State Government, under Section 168A of the Madhya Pradesh Goods and Services Tax Act, 2017 read with Section 20 of the Integrated Goods and Services Tax Act, 2017, amends Notification No. FA3-07-2021-1 -V-(26) by substituting specified calendar dates in clause (i), the proviso to clause (i), and clause (ii) of the first paragraph; the notification shall come into force with effect from the 30th day of May, 2021.

      Amendment in Notification No. F A 3-32-2017-IV (41) dated the 29th June, 2017
      Summary: The State Government amends the notification to insert a proviso applying a concessional state tax rate to services specified in clause (f) of serial number 3: for the period from 14th June, 2021 to 30th September, 2021 the state tax on those services shall be levied at the rate of 2.5 per cent irrespective of the rate previously specified; the amendment is effective from 14th June, 2021 and is made under specified provisions of the Madhya Pradesh GST Act.

      Providing the concessional rate of SGST on Covid-19 relief supplies, up to and inclusive of 30th September 2021
      Summary: The State Government prescribes partial exemptions of state tax for specified Covid-19 relief supplies by exempting state tax in excess of the rates listed for each tariff classification, covering items such as medical oxygen, specified medicines, testing and diagnostic kits, ventilatory devices, sanitizers and ambulances. The notification is effective from 14 June 2021 through 30 September 2021 and operates by capping state tax liability to the stated rates for the listed goods.

      Amendment notification No. FA-3-51-2019-1-V (29), dated the 4th May 2020
      Summary: The State Government, exercising powers under sub-rule (4) of Rule 48 of the Madhya Pradesh Goods and Services Tax Rules, 2017, amends an earlier departmental notification by inserting the words "a government department, a local authority" in the first paragraph immediately after the words "notifies registered person, other then", thereby expressly excluding government departments and local authorities from that registered person category.

      F A-3-26-2019-1-V(49) - dated - 8-7-2021 - Madhya Pradesh SGST
      Amendment in Notification No. F A-3-26-2019-1-V(53), dated the 29th June 2019
      Summary: Amendment substitutes "31st day of May, 2021" with "31st day of July, 2021" in the specified proviso of the notification, thereby extending the operative deadline, and declares the notification to be deemed to have come into force with effect from the 31st day of May, 2021, effecting a retrospective commencement of the amended provision under the State GST regulatory power.

      Amendment in Notification No. F-A3-93-2017-1-V(162), dated the 29th December 2017
      Summary: The amendment inserts a proviso waiving part of the late fee under Section 47 for registered persons who fail to furnish FORM GSTR 4 by the due date from financial year 2021 22 onwards: it excludes from recovery late fee amounts below defined thresholds for returns with nil state tax liability and provides a different threshold for other registered persons, thereby limiting the assessable late fee on delayed GSTR 4 filings.

      Seeks to rationalize late fee for delay in filing of return in FORM GSTR-7
      Summary: Waiver of late fee is granted for registered persons required to deduct tax at source who fail to furnish the return in FORM GSTR-7 for June 2021 onwards by the due date: the portion of late fee in excess of twenty-five rupees per day is waived, and the total late fee liability is waived where it exceeds one thousand rupees.

      Clarification regarding applicability of GST on the activity of construction of road where considerations are received in deferred payment (annuity)
      Summary: Exemption for annuity payments applies only to services of access to a road or bridge classified as operation/supporting transport services; annuity or deferred payments made for road construction are classified as general construction services and are not exempt under the annuity exemption provision, so GST applies to such deferred construction consideration.

      Clarification regarding GST on supply of various services by Central and State Board (such as National Board of Examination)
      Summary: GST exemption applies to services supplied by Central or State educational boards by way of conduct of examinations, including entrance examinations and any fee charged for such conduct. Input services relating to admission or conduct of examinations supplied to those boards-such as online testing, result publication, printing of admit cards, notifications and question papers-are also exempt. Services of accreditation or registration provided by those boards to institutions or professionals fall outside the examination exemption and are taxable under GST.

      Clarification regarding rate of tax applicable on construction services provided to a Government Entity, in relation to construction such as of a Ropeway on turnkey basis
      Summary: A ropeway constructed on a turnkey basis for a Government Entity is not "meant predominantly for use other than for commerce, industry, business or profession" and therefore does not qualify for the concessional entry for composite works contracts; such works contract services fall under the residual entry and attract the standard works contract GST rate.

      GST on milling of wheat into flour or paddy into rice for distribution by State Governments under PDS
      Summary: Composite supply of milling of wheat into flour or paddy into rice to State Governments for PDS is exempt under Entry 3A if the value of goods in the composite supply does not exceed 25% of the total value; if the goods value exceeds this threshold, the supply is taxable at 5% as a job work service when provided to a registered person, including those registered only for tax deduction purposes.

      GST on service supplied by State Government to their undertakings or PSUs by way of guaranteeing loans taken by them
      Summary: Guarantees issued by Central or State Governments for loans taken by their undertakings or public sector undertakings are specifically exempt from GST under Entry No. 34A of Notification No. 38/1/2017-Fin(R&C)(12/2017-Rate), and the GST Council has recommended reiteration of this exemption; the Goa Commissioner of Commercial Taxes has issued a circular reaffirming this position and inviting reports of implementation difficulties.

      Clarification regarding GST rate on laterals/parts of Sprinklers or Drip Irrigation System
      Summary: Parts and laterals that are suitable for use solely or principally with sprinklers or drip irrigation systems and that are classifiable under the HSN heading for sprinklers shall attract the same GST rate as the systems even when supplied separately; parts of general use that classify under other HSN headings shall attract the GST applicable to those respective headings.

      GST on service supplied by State Govt. to their undertakings or PSUs by way of guaranteeing loans taken by them
      Summary: Supply of guarantee services by a State Government to its undertakings or PSUs in respect of loans from banks and financial institutions is exempt from GST under Entry No. 34A of the State Tax rate notification; this exemption for government-guaranteed loans to undertakings and PSUs is reaffirmed and to be implemented from the notified effective date, with officers to report any implementation difficulties to the issuing office.

      GST on milling of wheat into flour or paddy into rice for distribution by State Governments under PDS
      Summary: The circular clarifies that milling of wheat into flour with fortification, or paddy into rice, supplied to a government for distribution under the Public Distribution System qualifies as a composite supply and is exempt under entry No. 3A if the value of goods in the composite supply does not exceed the prescribed threshold; otherwise, where the goods component exceeds that threshold the supply, when rendered as job work to a registered person, attracts the concessional job-work GST rate and persons registered only for tax deduction at source are treated as registered persons for this purpose.

      Clarification regarding rate of tax applicable on construction services provided to a Government Entity, in relation to construction such as of a Ropeway on turnkey basis
      Summary: Construction services supplied to a Government Entity for ropeway turnkey projects do not qualify for concessional GST treatment reserved for works contracts on structures meant predominantly for non commercial use; such ropeway constructions intended for commercial or tourism purposes must be classified under the general works contract category and taxed at the higher standard rate specified in the notification. The explanatory exclusion for government activities as public authorities does not extend concessional treatment to Governmental Authorities or Government Entities for commercially purposed structures.

      CIRCULAR No. 05/2021 (STATE) - dated 30-6-2021
      Clarification regarding applicability of GST on the activity of construction of road where considerations are received in deferred payment (annuity)
      Summary: The circular clarifies that the exemption for access to a road or bridge on payment of annuity applies only to services under heading 9967 and does not extend to construction services under heading 9954. Therefore, annuity or deferred payments received as consideration for construction of roads are not exempt under Entry 23A of the referenced notification.
