The Principal Commissioner/Commissioner of Customs, Nhava Sheva I, JNCH is designated to exercise those powers for adjudication of show cause notice F.No. DRI/BZU/F/04/2006 dated 13.05.2008 issued to M/s Tini Pharma & others.

      Tariff Notification in respect of Fixation of Tariff Value of Edible Oils, Brass Scrap, Poppy Seeds, Areca Nut, Gold and Sliver
      Summary: Amendment substituting TABLE-1, TABLE-2 and TABLE-3 of Notification No. 36/2001-Customs (N.T.) to fix tariff values for specified imports including edible oils, brass scrap, poppy seeds, areca nuts, and separate entries for gold and silver under referenced notification entitlements, effected by Notification No. 38/2019-Customs (N.T.) under section 14(2) of the Customs Act, 1962.

      Kerala Flood Cess (Amendment) Rules, 2019.
      Summary: The amendment substitutes the date in rule 1(2) of the Kerala Flood Cess Rules, 2019, replacing the 1st day of June, 2019 with the 1st day of July, 2019, thereby postponing the commencement date from which the flood cess shall be levied and collected, effected under the powers conferred by sub clause (3) of clause 14 of the Kerala Finance Bill, 2019.

      Amendment in the Notification No. F-A-3-33-2017-1-V(42) dated 29th June, 2017.
      Summary: Entry 452Q treats supplies by an unregistered person of goods (excluding capital goods and cement under chapter heading 2523) to a promoter for construction as taxable with the promoter liable as recipient under section 9(4) MP GST Act; it defines "promoter", "project", "REP" and "RREP" (commercial carpet area of commercial apartments not exceeding fifteen percent) and states the entry applies notwithstanding more specific headings, effective from April first, 2019.

      F-A-3-32-2017-1-V-(37) - dated - 17-5-2019 - Madhya Pradesh SGST
      Amendment in the Notification No. F-A-3-32-2017-1-V(41) dated 29th June, 2017
      Summary: The notification prescribes differentiated state-tax treatment and a one-time option to pay for construction services in REP and RREP, establishes project-wise formulas (Annexures) to compute eligible Input Tax Credit (Te) and reversal/retention amounts (Tx) based on carpet-area allocation, percentage invoicing, and percentage completion as on 31 March 2019, mandates an 80% registered-supplier sourcing threshold with reverse-charge on shortfalls (including cement from unregistered suppliers), and requires project-wise accounting, electronic reporting, and separate ITC computation by tax component, effective 1 April 2019.

      The Madhya Pradesh Goods and Service Tax Rules, 2019
      Summary: Amendments effective 1 April 2019 revise valuation and prescribe project-wise calculation, finalisation and reporting of input tax credit for construction services under clause (b) of paragraph 5 of Schedule II. They require use of carpet-area based ratios (E/F) and separate treatment for commercial portions, mandate reversals or claims by September following the financial year of completion/first occupation with interest consequences, allocate credit by tax type, permit assignment across multiple projects, and substitute multiple GST forms and procedures including requirement to declare amounts in FORM GSTR-3B or FORM DRC-03.

      KA.NI-2-691/XI-9(47) - dated - 1-5-2019 - Uttar Pradesh SGST
      Amendments in the notification No. KA.NI-2-836/XI-9(47)/17-U.P.Act-1-2017-Order-(06)-2017 dated 30th June, 2017.
      Summary: Insertion of entry 452Q in Schedule III (9%) makes supply of any goods, other than capital goods and cement under Customs Tariff chapter 2523, by an unregistered person to a promoter taxable where the promoter is liable to pay tax as recipient under the reverse charge mechanism. "Promoter" adopts the Real Estate (Regulation and Development) Act definition; "project" means REP or RREP; RREP limits commercial carpet area to not more than 15% of total carpet area. The entry applies to goods satisfying these conditions even if covered by a more specific tariff heading.

      KA.NI-2-690/XI-9(47)/17 - dated - 1-5-2019 - Uttar Pradesh SGST
      Notifies the following classes of registered persons.
      Summary: Designates promoters who receive development rights/FSI or long-term land lease for residential construction and who pay consideration in construction services or as upfront amounts as registered persons for state tax. The liability to pay state tax on consideration paid in construction services, monetary consideration for residential construction, upfront lease amounts, and construction services supplied for development rights/FSI arises on issuance of the project's completion certificate where required or on first occupation, whichever is earlier. Definitions from the Real Estate (Regulation and Development) Act, 2016 apply and the tax is payable under reverse charge mechanism.

      KA.NI-2-689/XI-9(47)/17 - dated - 1-5-2019 - Uttar Pradesh SGST
      Amendments in the Notification No.KA.NI-2-844/XI-9(47)/17-U.P.Act-1-2017-Order-(11)-2017 dated 30th June, 2017.
      Summary: The notification amends the Uttar Pradesh GST notification to add services of transfer of development rights or additional FSI to a promoter for project construction and long term leases of land where consideration is an upfront amount and/or periodic rent for construction by a promoter; it also inserts definitions aligning apartment, promoter, project, real estate project and residential real estate project with the Real Estate (Regulation and Development) Act, 2016 and limits residential projects by commercial carpet area proportion.

      Amendments in the Notification No. KA.NI.-2-843/XI-9(47)/17-U.P. Act-1-2017-order-(10)-2017 Dated 30th June, 2017.
      Summary: The amendment provides GST exemption on transfer of development rights/FSI and upfront amounts for long term leases for construction of residential apartments from 1 April 2019, calculated by pro rata carpet area share; promoters must pay tax on unsold residential portions on a reverse charge basis using a pro rata formula capped by specified percentages, with tax liability arising on issuance of completion certificate or on first occupation. Deeming rules fix value of TDR/FSI and unsold portions by reference to prices of similar apartments; key definitions are aligned to the Real Estate (Regulation and Development) Act.

      Prescribing persons liable to pay tax on reverse charge for the Uttar Pradesh Goods and Services Tax Act, 2017.
      Summary: Reverse charge requires the recipient promoter to pay tax where goods or services received from an unregistered supplier constitute the shortfall from the minimum purchases a promoter must procure for construction of a real estate project; this covers specified goods and services, cement under the Customs Tariff heading, and capital goods supplied to a promoter on which tax is payable at the prescribed rate, with terms defined in alignment with the Real Estate (Regulation and Development) Act, 2016.

Bonds pay fixed interest at 2.50% per annum, payable half-yearly, are redeemable at eight years (premature redemption allowed after year five), convertible to Demat, transferable, eligible for trading, usable as collateral subject to LTV norms, and feature taxable interest but exemption of capital gains on redemption for individuals with indexation on transfers.
