      Seeks to amend Australia FTA notification to make changes in tariff preference given to Coking Coal and Raw Cotton arising out of Finance Act, 2023
      Summary: The central government amends Notification No. 62/2022-Customs by omitting S.No. 6 in Table II, substituting S.No. 7 with HS code 27011210 designated as "All goods", and inserting HS codes 27011290 and 27011910 with their respective treatments; Table IV S.No.1 is revised to list HS codes 52010024 and 52010025 described as "Cotton of minimum 28 mm staple length." These changes adjust tariff classifications and associated preferential treatment pursuant to statutory authority.

      Securities and Exchange Board of India (Issue of Capital and Disclosure Requirements) (Second Amendment) Regulations, 2023
      Summary: The amendments replace and standardise underwriting provisions: issuers seeking underwriting for initial or further public offers must enter underwriting agreements with registered merchant bankers, stock brokers, lead managers or syndicate members prior to filing the prospectus or red herring prospectus, specifying maximum subscriptions and obligations for rejected bids at prices not less than the issue price, disclose such agreements in the prospectus, require lead managers to meet minimum underwriting obligations and to cover syndicate defaults, and limit underwriting subscriptions solely to fulfil underwriting obligations.

      Instruction No. 17/2023 - dated 18-5-2023
      Requirement of EPR registration certificate for import of battery as well as equipment containing battery
      Summary: Customs must verify CPCB-issued EPR registration certificates when clearing imports of batteries and equipment containing batteries. Under the Battery Waste Management Rules, 2022, importers are treated as producers and must obtain CPCB EPR registration via the centralised portal; CPCB publishes registered producers and issues EPR certificates for recyclers/refurbishers. Producers must file plans and returns, meet collection and recycling/refurbishment targets, and may use tradable EPR certificates to meet obligations; CPCB and State boards can suspend registrations and impose environmental compensation for non compliance.

      E-waste (Management) Rules 2022 - regarding release of imported consignments of producers of 85 EEEs items (ITEW 17 to ITEW 27, CEEW 6 to CEEW 19, LSEEW 1 to LSEEW 34, EETW 1 to EETW 8, TLSEW 1 to TLSEW6, MDW 1 to MDW 10 and LIW1 to LIW 2)
      Summary: Customs shall release imported consignments of producers/importers of 85 specified EEE items on submission of a prescribed undertaking (emailed to the designated CPCB address) and a commitment to submit the online EPR Registration Certificate by 30.06.2023; producers of 21 specified EEE items with expired EPRA may secure release by providing an EPR Portal acknowledgement of application together with a copy of the expired EPRA. These interim measures are valid until 30.06.2023.
