Comparable GST tax base governs revenue growth calculations, excluding discontinued compensation cess from year-on-year comparisons across different levy structures.
GST revenue growth must be calculated on a comparable tax base using the same levies for both periods. CBIC treats year-on-year growth based on Central GST, State GST and Integrated GST as the appropriate comparison and considers the inclusion of compensation cess from a different levy structure misleading. Compensation cess was discontinued except for tobacco and related products from 22 September 2025, with the remaining tobacco-related cess removed from 1 February 2026. Input tax credit mismatch alone cannot support fraud-based GST demand without an assessing officer's recorded satisfaction of fraud or suppression.
Section 74 GST demand proceedings require the assessing officer's independent satisfaction of fraud, wilful misstatement or suppression of facts. An input tax credit mismatch or alleged short payment alone cannot establish these conditions. Unsupported assertions of suppression for invoking extended limitation are insufficient, and audit objections cannot replace the assessing officer's satisfaction. A show cause-cum-demand notice lacking factual allegations of a deliberate device to evade tax or avail excess input tax credit is vulnerable.

Lucknow, Aug 24 (PTI) The Enforcement Directorate on Monday carried out searches at multiple locations in Uttar Pradesh and Haryana as part of a money laundering investigation linked to a GST fraud case, officials said.

Nine premises in Muzaffarnagar and Ghaziabad in Uttar Pradesh, apart from those in Haryana's Faridabad, were searched under the provisions of the Prevention of Money Laundering Act (PMLA) leading to seizure of Rs 1.1 crore in cash from two locations in the two UP cities, they said.

The investigation is related to "fraudulent" availment of bogus Input Tax Credit (ITC).

The probe involves a company named Jambudwip Exports and Imports. It is alleged that the company generated and passed bogus ITC through fabricated invoices and e-way bills without actual movement of goods, the officials said.

The company could not be contacted immediately for a comment on the ED action.

The ED alleged that the company deployed circular transactions, layered funds and cash withdrawals through multiple bogus/non-existent entities.

Goods and Services Tax (GST) authorities established fraudulent availment of Rs 9.63 crore ITC, resulting in wrongful loss to the government exchequer.

Searches were aimed at tracing the proceeds of crime, identifying further beneficiaries and unearthing documentary and digital evidence relating to the alleged fraudulent ITC network, the officials said. PTI NES KVK KVK
