ITC on Payment made under section 73 after DGGI Investigation

Input tax credit on DRC-03 payments depends on the demand basis and independent eligibility conditions.
Input tax credit on DRC-03 payments depends on the statutory basis of payment and independent fulfilment of credit conditions. Section 17(5)(i) blocks credit for tax paid under Sections 74, 129 and 130, but not expressly under Section 73. Payment under Section 73 does not itself create entitlement. Credit may be available for an eligible inward supply where statutory conditions are met, while amounts paid to reverse wrongly availed credit cannot be reclaimed merely because payment is made under Section 73. (AI Summary)

Can ITC on DRC-03 paid under section 73 after DGGI investigation be availed? Because as per section 17(5) of CGST, ITC paid under section 74  can't be vailed. and if DGGI comes in to picture can payment under section 73 be made? any case law?

No hope at all. SCN would be issued under Section 74 and not under Section 73.

When an assessee deposits tax on being DETECTED by DGGI, the element of voluntary deposit is absent. Rather, suppression of fact etc. is clearly present. The ingredients of Section 74 are here. So no case law can help in this scenario.

Yes, ITC may be available, subject to the nature of the payment and the underlying transaction.

  1. Section 17(5)(i), CGST Act: Specifically blocks ITC of tax paid under Sections 74, 129 and 130. Section 73 is not included. Thus, payment under Section 73 is not automatically hit by this restriction. However, ITC must independently satisfy Sections 16 and 17.
  2. DGGI investigation: DGGI involvement does not automatically require payment under Section 74. Section 73 may apply where fraud, wilful misstatement or suppression to evade tax is not involved. Section 73(5) permits voluntary payment before notice.
  3. Case law: Mahavir Singh v. Assistant Commissioner (2024 (3) TMI 269 - DELHI HIGH COURT) and B.G. Granites v. Assistant Commissioner (2025 (11) TMI 180 - KARNATAKA HIGH COURT) concern voluntary payment/coercive recovery during investigation. They should not be cited as directly deciding ITC eligibility under Section 17(5)(i).

Conclusion: DRC-03 payment under Section 73 does not, by itself, create ITC entitlement. If the payment represents tax on an eligible inward supply, ITC may be available subject to statutory conditions. If it represents reversal of wrongly availed ITC, the amount cannot be reclaimed merely by paying under Section 73.

For FY 2024-25 onwards, examine Section 74A and the applicable transitional provisions.

If the issue arises after FY 2022 23, closure under Section 73 is possible only if you clearly establish absence of fraud, suppression, or wilful misstatement. However, enforcement formations, especially DGGI invoke Section 74, and the burden lies on the department to prove the statutory ingredients of Section 74.

High Courts have indeed quashed Section 74 notices where these ingredients were not demonstrated, but litigation is long and demanding.

The SCN if issued u/s 74 can be contested to the extent that there is no fraud / suppression and when that attains finality you are eligible forthe credit. So you can take the credit and not utilise it until u get a final order that the demand isu/s 73
