Telecommunications switch parts classification treats integrated chassis-backplane assemblies as apparatus parts eligible for basic customs-duty relief.
Model-specific RSA chassis and backplane assemblies with integrated backplane PCBAs, imported without interface cards, power modules or processor/control cards, are classified as parts of heading 8517 under tariff item 8517 79 90. They lack the essential character and independent signal-processing function of complete photonic service switches and are solely or principally suitable for those switches; the integrated assembly is not merely a populated printed circuit board. Goods under that tariff item qualify for nil basic customs duty under Serial No. 5(a) of Notification No. 57/2017-Customs, unless they are parts of cellular mobile phones or wrist wearable devices. The relief applies only to basic customs duty, not integrated tax or other duties, taxes or cesses.
Issues: (i) Classification of the imported RSA Backplane and Chassis Assemblies, with integrated backplane PCBAs, under tariff item 8517 79 90 of the Customs Tariff Act, 1975; (ii) Eligibility of those classified goods for Nil basic customs duty under Serial No. 5(a) of Notification No. 57/2017-Customs dated 30.06.2017.
Issue (i): Classification of the imported RSA Backplane and Chassis Assemblies, with integrated backplane PCBAs, under tariff item 8517 79 90 of the Customs Tariff Act, 1975.
Analysis: The photonic service switches are apparatus of heading 8517. Under Rule 2(a) of the General Rules for the Interpretation, the imported assemblies, without interface cards, power modules, processor or control cards, cannot themselves receive, convert, switch or transmit signals and do not possess the essential character of a complete photonic service switch. Notes 1(f) and 2 to Section XV, and Note 1(g) to Section XVI, exclude treatment as base-metal articles or parts of general use. Under Note 2(b) to Section XVI, the assemblies are parts suitable solely for particular models of photonic service switches: they house, align, interconnect and power the modules required for the switch to function. The integrated chassis-backplane assembly is not merely a populated printed circuit board under tariff item 8517 79 10; it is an assembled part of the heading 8517 apparatus.
Conclusion: The classification issue is decided in favour of the assessee: the imported assemblies are classifiable as other parts under tariff item 8517 79 90.
Issue (ii): Eligibility of those classified goods for Nil basic customs duty under Serial No. 5(a) of Notification No. 57/2017-Customs dated 30.06.2017.
Analysis: Serial No. 5(a) covers goods falling under tariff item 8517 79 90, except parts of cellular mobile phones or wrist wearable devices, and specifies no condition. The assemblies are parts of photonic service switches and do not fall within either exclusion. The notification exempts only basic customs duty leviable under the First Schedule and does not extend to integrated tax under Section 3(7) of the Customs Tariff Act, 1975, or other duties, taxes or cesses.
Conclusion: The eligibility issue is decided in favour of the assessee: the goods qualify for the Nil rate of basic customs duty under Serial No. 5(a) of Notification No. 57/2017-Customs dated 30.06.2017.
Final Conclusion: Complete model-specific chassis and backplane assemblies, imported without the functional modules of the switch, are treated as parts of the telecommunications apparatus, with the stated notification relief confined to basic customs duty.
Ratio Decidendi: A model-specific integrated chassis-backplane assembly having no independent function and suitable solely or principally for a machine of heading 8517 is classifiable as a part of that machine under tariff item 8517 79 90, notwithstanding the presence of an integrated backplane PCBA.
