Mobile-phone parts classification covers specially engineered components, enabling manufacture-linked customs exemption while excluding goods added after filing.
Mobile-phone parts classification under Rule 1 of the General Rules for Interpretation and Section XVI Note 2(b) covers specially designed aluminium plates, magnesium alloy sheets, thermal-management materials, antennae, tape and dust-proof paper where they are solely or principally used in mobile-phone manufacture. Further machining, stamping or lamination does not alter that character. These goods qualify for the manufacture-linked customs exemption where their prescribed end use in intermediary or finished mobile phones is established and verified. Low-viscosity polymer granules introduced after filing fall outside the advance-ruling scope because they were not identified in the original application.
Issues: (i) Whether aluminium plates, magnesium alloy sheets, heat-dissipating films, silicon pads, conductive foams, antenna, double-sided tape and dust-proof paper are classifiable under Tariff Item 8517 79 90 as parts of mobile phones; (ii) Whether aluminium plates, magnesium alloy sheets, heat-dissipating films, silicon pads, conductive foams, antenna, double-sided tape and dust-proof paper qualify for exemption under Serial No. 6E of Notification No. 57/2017-Customs dated 30.06.2017; (iii) Whether polymer granules with low viscosity introduced through subsequent submissions fall within the scope of the advance ruling application.
Issue (i): Whether aluminium plates, magnesium alloy sheets, heat-dissipating films, silicon pads, conductive foams, antenna, double-sided tape and dust-proof paper are classifiable under Tariff Item 8517 79 90 as parts of mobile phones.
Analysis: Under Rule 1 of the General Rules for Interpretation, read with Note 2(b) to Section XVI, goods suitable solely or principally for use with machines of heading 8517 are classified with those machines. The articles were specifically cut, treated and dimensionally engineered for integration into mobile-phone covers, frames and thermal-management layers; they were not generic raw materials or parts of general use. Subsequent machining, stamping or lamination did not detract from their essential character or their sole or principal use in mobile-phone manufacture.
Conclusion: In favour of the assessee, the listed subject goods, excluding polymer granules, are classifiable under Tariff Item 8517 79 90 as parts of mobile phones, subject to exclusive use in manufacture of intermediary or finished smartphones/mobile phones and verification by the field formation.
Issue (ii): Whether aluminium plates, magnesium alloy sheets, heat-dissipating films, silicon pads, conductive foams, antenna, double-sided tape and dust-proof paper qualify for exemption under Serial No. 6E of Notification No. 57/2017-Customs dated 30.06.2017.
Analysis: Serial No. 6E grants exemption to inputs or parts used in the manufacture of goods specified at Serial No. 6D, including mobile-phone covers. The classified articles are inputs or parts used for manufacture of the specified intermediary goods and meet the manufacture-linked end-use requirement.
Conclusion: In favour of the assessee, the listed subject goods, excluding polymer granules, qualify for the Serial No. 6E exemption, subject to exclusive use in manufacture of intermediary or finished smartphones/mobile phones and verification by the field formation.
Issue (iii): Whether polymer granules with low viscosity introduced through subsequent submissions fall within the scope of the advance ruling application.
Analysis: The polymer granules were absent from the goods identified in the original application. Section 28H(1) of the Customs Act, 1962 and Regulation 15(1) of the Customs Authority for Advance Rulings Regulations, 2021 confine a ruling to the specified goods and questions. Their later inclusion would materially expand the application without jurisdictional comments, contrary to the principles of natural justice.
Conclusion: This issue is decided against the assessee: polymer granules with low viscosity are outside the scope of the proceedings and are not covered by the ruling.
Final Conclusion: The enumerated, specially designed articles receive machine-parts classification and the corresponding manufacture-linked customs exemption when their prescribed mobile-phone end use is established; polymer granules added after filing remain outside the ruling's coverage.
Ratio Decidendi: Goods specifically designed and suitable solely or principally for use in mobile-phone manufacture retain their character as parts under Section XVI Note 2(b) notwithstanding further processing after import.
