NANDKUMAR SAGWEKAR

Dear All Learned Members of this forum

One of my friend has recently started a factory manufacturing excisable goods and we also obtain the Central Excise Registration , I have guide him properly so far as clearance of goods for Home consumption , Cenvat & Service tax. Now Our first three orders are as 1. Merchant export 2. EOU 3. Home consumption. May I wish to seek the expert advice for Merchant export ( and wimerchant exported informed us that he has executed bond with authoritiesll issue as CT 1 ) and EOU ( they inform us that they will issue us CT - 3 ) clearance with respect to following:

1. Whether sealing is necessary ? If yes then whether  in presence of C.excise officer is necessary ?

2. Whether we have to take prior permission for such clearance from Central excise ?

3. Whether proof of exports to be submitted by us  ?

4. Brief procedure ? the expected date of clerances are given by the buyer are second week of march 2013

Thanks

Understanding Merchant Export Procedures: No Sealing Needed, Submit CT-1/CT-3, Customers Provide Export Proof. See Notification 41/2001-C.E. A registered Central Excise Assessee inquires about procedures for merchant export, EOU, and home consumption for their factory's excisable goods. They seek advice on whether sealing is necessary, the need for prior permission from Central Excise, and the submission of export proof. In response, it is clarified that sealing is not required, a copy of CT-1/CT-3 must be submitted to the Central Excise Department, and the customers will provide the proof of export. Reference to Notification No. 41/2001-C.E. is suggested for further guidance. (AI Summary)

Dear Mr. Anand,

Please find appended replies to your queries:-

  1. Sealing is not necessary.
  2. You would have to submit a copy of CT-1/CT-3 to the jurisdictional Central Excise Department.
  3. Proof of export would be submitted by your customers since they have executed the Bond.  An acknowledged copy of proof of export may be obtained by you from your customs and for future usage you would have to keep it.
  4. Please refer Notification No. 41/2001-C.E. in this regard.
