Legal Metrology Act

vijay gupta

Hello Sir,

My query is that my brother has retail garment shop and he sold one socks to a person. Then he sent him notice Under legal metroligy that there is no mandatory decalartion on the socks packet and two MRP one Rs.20/- and other Rs.40/-. So this is punishable offence and compounding fee is Rs.2500/- otherwise you have to face trial in court of law. Sir i wnat to know is this type garment retail item are covered under this act .

Product labelling requirements under legal metrology require labelled packaged goods; non-compliance attracts compounding or prosecution. Packaged retail articles must display prescribed pre-printed particulars including item name, declared quantity, Maximum Retail Price inclusive of taxes, month and year of manufacture, manufacturer name, and customer care details; absence of mandatory declarations or multiple MRPs can trigger enforcement under the Legal Metrology Act and Rules, with compounding of the offence typically available as an alternative to prosecution. Yes please, as per the provisions of packaging coomodities rules under legal metrology act, any item which is sold in packaged condition should have a label containing certain pre-printed details.  The details are name of the item, quantity, MRP inclusive of taxes, month and year of manufacture, manufacturer name, customer care details.

There is no other way except to pay the compounding fees of Rs. 2,500/-.  You would have to comply the provisions of Legal Meterology Act read with Rules.
