sales return / unfructified sales - diff

venkat eswaran

Sir,

waht is difference between sales return and unfructified sales in relation with SALES TAX ANGLE.

Unfructified sales: transactions void ab initio where goods are not taken or conditions unfulfilled, distinct from sales return. Sales return is a reversal of a completed sale where goods are returned for reasons like inferior quality or wrong quantity; unfructified sales are transactions void ab initio because essential conditions were not met, payment was not made, or the buyer did not take delivery, and thus the sale is treated as never perfected. Well, Sale Return means, returning the goods on quality or quantity reasons, where unfructified sales is void at ab-initio (i.e. due to non payment of sale and non fulfilment of conditions of mercantile laws).

"unfructified sales" means where the goods sold are returned for the reason that they were not taken delivery of by the person to whom they were intended and "sales return" on normal basis means return due to inferior quality or by some other reason.
