Case law - 'ERP IMPLIMENTATION SERVICE'

Vijay Chitte
'ERP IMPLIMENTATION SERVICE' is presently exempted service in the category of Consulting engineer service? If, YES, Any one can provide me any case law for that.
ERP Implementation Services Not Exempt from Service Tax; Unclear Classification Under Management Consultancy A query was raised regarding the exemption of 'ERP Implementation Service' from service tax under the category of consulting engineer service. The response indicated that there is no current exemption for ERP implementation services. It was noted that such an exemption existed in 2005 under management consultancy. However, there is uncertainty about whether it is appropriate to classify ERP implementation under management consultancy for tax purposes. (AI Summary)

AS on date I have not across any exemption for ERP implementation. This exemption was available in 2005 under management consultacny. My view is that the same maybe liable on a converse reasoning but whether it is proper to classify under MC is not sure.
