TDS on compensation paid for cancellation of an agreement

TDS applicability on compensation depends on the payment's legal character; deduct TDS if it falls within taxable compensation categories.
Applicability of TDS on compensation for cancellation depends on the transaction's nature, reasons for cancellation, the character of the original contract (e.g., works contract), and which party is liable. If the compensation is classified within a statutory category subject to TDS, the payer must deduct TDS; otherwise deduction depends on the legal character of the payment and the relevant TDS provision. (AI Summary)
Whether TDS is applicable on compensation paid for cancellation of an agreement to sell.

1. It is the nature of transaction which enables to determine the applicability of TDS provisions. Why the contract was cancelled. What is the overall nature of cancelled contract. Is it in the nature of works contract. How is liable to pay the compensation etc. etc. As such there is category which specifically stipulates the deduction of TDS on compensation. But, if such compensation is in the nature of category on which TDS is liable to be deducted, you need to deduct TDS.
