Dear Sir / Madam,
Our company is a PVT LTD company having a registered office in Tamilnadu. We are not registered in PF and ESIC till now.
We exceed a threshold limit of 10 employees on July 21, hence we are coming under compulsory ESIC registration, we are unable to register PF and ESIC through Shram Suvidha because as we are a Pvt Ltd Company not eligible to register through Shram Suvidha. Hence we tried to register through Agile form INC 35, but it is registering only for new companies not for an Existing companies registered in MCA 5 years back. Please assist me on this PF and ESIC registration process for an existing Private Limited companies.
ESIC and Provident Fund registration requirement arises when employee threshold is crossed; existing private companies face portal eligibility barriers. Existing Private Limited companies that cross the employee threshold must effect statutory enrolment: ESIC registration becomes compulsory and Provident Fund registration applies where conditions are met. The procedural difficulty described is that Shram Suvidha portal is not permitting registration for this corporate form and the AGILE (INC-35) mechanism is only enabling registration for newly incorporated companies, leaving existing companies to seek alternative registration routes or direct engagement with the PF/ESIC registration authorities.
