Manpower Service Provider Debates Need for Separate GST Registration for New Contract in Madhya Pradesh A query was raised regarding whether a business providing manpower services in Maharashtra, which has GST registration there, needs separate GST registration in Madhya Pradesh upon receiving a new contract. Responses varied: one advised that separate registration is necessary to avoid losing input tax credit (ITC) on local procurements, while others suggested it is not required, as services can be billed under IGST. It was noted that not having registration in Madhya Pradesh could lead to loss of ITC on local CGST and SGST, and additional compliance costs should be considered. (AI Summary)

Sir,

The answer is an emphatic 'yes'.

Rajendra Prasad on Dec 15, 2019

Dear Mr Ganesh,

There is no need to obtain registration in every state. You can raise IGST bill. If you have any procurement in MP State with MP SGST + CGST you will loose the ITC , if you do not have MP registration.

In your case normally there will not be any ITC for manpower supply.

If you add new registration , then compliance cost will go up.

Hence check all the pros and cons before taking a decision.

New registration is not required. Covered under Section 12(2) of IGST act.

PAWAN KUMAR on Dec 15, 2019

dear sir,

as per my view the option is available whether to obtain registration or not, if any service will be procured in mp state which will liable for cgst +sgst, claim of itc will not be admissible since no gst registration in that state.
