EPCG License date problem

Kishan Barai

My Friend CA needs to authorize EPCG & it's procedures but in shipping bill filed by CHA for Exports we find only EPCG Licence number but not date & as per norms, please help us to solve this issue

Where can we find the date ?

Which date has to be mentioned in S/B for EPCG exports for fulfilling EO ?

As per rules it is mentioned...

'In case where shipping bill do not contain the EPCG authorization & date an affidavit from the authorization holder has been obtained that the export account for the fulfillment of specific EO against this EPCG authorization shall not be taken into consideration'

Please enlighten on this issue

EPCG licence date omission: clerical error that does not bar export obligation fulfilment and may be condoned administratively. Omission of the EPCG licence date on shipping bills is a clerical documentation issue; the date of the EPCG licence is its date of issuance. Such omission does not automatically invalidate exports for fulfilment of the export obligation, and a chartered accountant's certificate is given practical significance. Administrative condonation or waiver by the EPCG Committee or DGFT is the available remedy to regularise missing licence dates, which is treated as a non-substantive clerical error. (AI Summary)

The date of EPCG is date of issuance of License. In any case you may approach to EPCG Committee for non mentioning of EPCG License number on the S/B. EPCG Committe may waive off or condone the same.

Thanks for replying

As per certificate
CA have to verify that in shipping bill authorisation license no and date is mentioned

However in all the shipping bills there are only licence no. Mentioned date is not mentioned in any bills

There will be no issue, even if date of EPCG License is not mentioned on the shipping bills. Such discrepancies can be either ignored or can be condoned by the DGFT/EPCG Committee.

This seems to be clerical issue. EPCG number is mentioned but date is not mentioned which seems would not pose any issue. Thanks. Once CA certificate is seen by the department they do not tend to investigate more into the documents. CA certificate has significance.
