Tds on insurance claim in bike showroom

TDS on insurance compensation may not apply where the payment is a pure indemnity; only interest is taxable.
TDS on insurer payments for vehicle repair depends on the nature of the amount: pure compensation or indemnity without an interest or income component is not ordinarily subject to withholding, whereas any interest element or income component is subject to TDS; recipients who merely pass funds to the insured without profit should query the insurer about the basis for deduction and may seek refund or clarification if tax was withheld improperly. (AI Summary)

3. In my view compensation is not subject to TDS on the condition that there is no interest element. Tds is only applicable on interest received for delay in receiving compensation. you may ask the insurance company on what basis they are deducting Tds. Further I understand that you are transferring the same amount received from insurance company to the insured. you do not have any profit built in it.

4.

You can ask the Insurance about the nature of deduction of tax and take action accordingly.
