EXTENSION FOR PAYMENT OF SERVICE TAX

DR.MARIAPPAN GOVINDARAJAN

The entire Chennai and surrounding cities are surrounded by floods and all infrastructures failed. In such circumstances whether CBEC will extend the date of payment of service tax to some extend considering the circumstances of the present position?

Extension of tax payment and return filing granted for assessees affected by natural calamity, easing compliance deadlines. CBEC granted administrative extensions for payment of Central Excise duty and service tax and for filing of monthly central excise returns and specified ER forms for assessees in Tamil Nadu due to flood-related disruption, deferring the original deadlines to later dates and citing the natural calamity as the ground for relief. Sir,

I am sure Govt. of India will agree to grant extension as the stipulated dates are practically applicable only in normal circumstances.

DR.MARIAPPAN GOVINDARAJAN on Dec 3, 2015

Dear Sirs,

I have contacted 011 23095496 and narrated the calamity in Chennai and around Chennai. It was informed that Member (Service Tax) retired on 30.11.2015 and a New Officer is to take charge. On his assumption of charge the extension of time will be considered by him. He requested to wait for two days. We shall wait.

First of all we feel very bad about the conditions prevail in Chennai/Tamil Nadu due to heavy rain. We would be contributing to the State in one way or the other. Thanks and salute to all those have extended their support to Chennai being residing in Chennai. Further I also would like to appreciate the effort Mr.Mariappan sir has initiated. Big pat to him. Further department would definitely take a favourable decision similar to the way it has taken during Uttarakhand flood.
YAGAY andSUN on Dec 6, 2015

My instinct is proved right. but obvious department does such extension in all special cases like this one. Further the notification is yet to be published to give effect to the extension.
DR.MARIAPPAN GOVINDARAJAN on Dec 7, 2015

Being Saturday and Sunday holidays, we may expect the circular for the extension date for payment of tax/duty today.

YAGAY andSUN on Dec 7, 2015

Dear All,

All credit goes to 'Mariappan Sir', who personally took this initiative for a noble cause, discussed this matter with Board (i.e. CBEC) and succeeded in his efforts, in true sense.

THANK YOU SIR

Sh. Ganeshan Kalyani Ji,

It is your 'hunch' has proved right and not 'instinct'.

KASTURI SETHI on Dec 8, 2015

Sh.Ganeshan Kalyani Ji,

I got myself registered with TMI on 4.9.2015. In three months I remained very busy with this site. I really relished the association of experts on this forum. Now if there is less work with me I am not worried. I find no problem in passing time. I am of the view that sitting idle is punishment for me. I accept and contest only those cases which are sustainable on merits. After retirement I feel that clients/assessees are interested in relief only and whether the case is sustainable on merit or not they do not bother. Such type of consultancy does not suit me. I have got the best platform for sharing and updating knowledge.

Ganeshan Kalyani on Dec 8, 2015

Yes Kasturi sir the forum is very vibrant and live. I believe in sharing and enriching knowledge of others as well mine. I have observed that your replies are strongly supported by Law and explanation is simple for anyone to understand. Thanks for sharing your very valuable knowledge, views etc. Thanks.

DR.MARIAPPAN GOVINDARAJAN on Dec 11, 2015

Except the press release till date no letter has been issued by the Department about this extension.
