Dear Members,

Please suggest whether Sec.271 of Companies Act 2013 has been notified or not? If I suppose to issue notice for winding up of a company then which sec. would be applicable whether it is Sec.271 of Companies Act 2013 or Sec.433 and 434 of Companies Act 1956.

The winding up provisions of the Companies Act, 2013 have not been notified; until those provisions are notified, practitioners must continue to rely on the winding up provisions of the prior Companies Act for issuing notices and conducting winding up proceedings. The provisions relating to the winding up under the Companies Act, 2013 have not yet been notified. You have to follow Sections of Companies Act,1956.
