Gratuity in Case of Death

MITSUI PRIME ADVANCED

Dear Sir

Please Clarify, In case of Death What is the Liability of Gratuity before completing service of 5 Years.

Regards

Lokesh Kumar

Gratuity entitlement on death requires employer payment even if five-year continuous service is not completed under law. Gratuity entitlement arises on completion of service or on the employee's death, with the death event triggering payment irrespective of whether the employee completed five years' continuous service, obliging the employer to pay the gratuity amount even when the statutory five-year service threshold has not been met. Gratuity is payable on the completing of services or death, whichever is earlier.

The Gratuity has to be paid even though the employee has not completed 5 years continuous service.
