100% EOU - Capital Goods warehousing period

SARAVANAN RENGACHARY

What is the present practice for Capital Goods warehousing period extension?.

should a separate application be filed in addition to extension application for warehousing license period.

please share your views.

Capital goods warehousing period: timely extension application to the commissioner before expiry; no separate licence application needed. Capital goods deposited in a customs warehouse may be retained until the expiry of five years from deposition; continuation beyond that period requires filing an extension application with the customs commissioner before the retention period expires. No separate application for the warehousing licence period is necessary when seeking an extension; a single timely application suffices. (AI Summary)

As per the provisions under customs act, capital goods may remain in the warehouse till the expiry of five years from the of deposition into warehouse. The application for request for extension of warehouse shall be filed with the commissioner of customs prior to 15 days of expiry date. No need to file the separate application, only application request for extension is to be filed.
