Spares imported under zero duty EPCG scheme - Installation certificate reg.
We have received Spares under Zero duty EPCG Scheme (Notification No. 102/2009 (Customs). The Spares received were installed in the factory. Beside our request letters to the jurisdictional Excise Range & Division, the installed spares are not physically verified and the installation certificate is pending since last couple of months. We are registered with Central Excise, hence, we do not have option to obtain certificate from independent Chartered Engineer (Notification No. 64/2008 – Customs dt. 09/05/2008). Kindly advice in the matter.

Company Faces Certification Delay Under Zero Duty EPCG Scheme; Options Include RTI Filing and Reminder Letters A company imported spares under the Zero Duty EPCG Scheme and faced delays in obtaining an installation certificate from the Central Excise authorities, despite multiple requests. Since they are registered with Central Excise, they cannot use an independent Chartered Engineer for certification. Suggestions included meeting with Central Excise officials, sending reminder letters, and potentially filing an RTI application. Another response advised patience, noting the three-year timeframe for certificate submission and the busy period for officers. Additionally, if no response is received within 30 days of application acknowledgment, it is assumed the goods are installed, allowing submission of a Chartered Engineer certificate. (AI Summary)
