PAN requirement for foreign companies: failure to obtain PAN triggers higher TDS and requires Form 15CA and 15CB for remittances.
A foreign company seeking a PAN must supply its registration certificate duly attested by an Indian mission or apostille. If the foreign entity lacks a PAN, payers in India must apply higher withholding under TDS rules. For remittance of license or technical fees, the remitter must file Form 15CA and obtain a Form 15CB certificate from a practising chartered accountant prior to payment. (AI Summary)

What are the requirement to apply the PAN card in India for foreign company having plant in India to transfer license fee and what would be the tax?

Dear Mr. Shetty,

Requirement for a Foreign Company for getting PAn Card in India is :

"Copy of registration certificate of the respective country duly attested by Indian Embassy/ Consulate/ High Commission/ Apostille in the country".

If you dont have PAN of a Foreign Company then you are required to deduct TDS @ 20%, else provisions for deducting TDS should be considered.

For the remittance of fees, you are required to fill the Form 15CA & 15CB from a Practicing Chartered Accountant.

Regards,

Mayank
