Issues: Whether the product "Desoldering Pump" was correctly classifiable under Chapter Heading 8468.00 as apparatus for soldering, or under Chapter Heading 8467.00 as tools for working in hand, and whether the demand, penalty and confiscation based on alleged misclassification and suppression were sustainable.
Analysis: The classification was initially approved by the department after examination of the product and leaflet, and the reclassification was attempted by the Addl. Collector on the basis of his personal observation without obtaining technical or trade opinion. The product was found to be used along with soldering work on printed circuit boards for sucking molten solder, and the technical opinions on record supported its character as an accessory to soldering rather than a hand tool. The HSN Explanatory Notes for Heading 84.67 showed that the heading covers tools for working in hand only where they have the relevant pneumatic or self-contained non-electric motor features, which the product lacked. In these circumstances, the reclassification, the allegation of suppression, and the invocation of the extended period and confiscatory provisions were not justified.
Conclusion: The product was not classifiable under Heading 8467.00, the proceedings under Section 11A and Rule 9(2) were not maintainable on the facts, and the penalty and confiscation were unsustainable.
Final Conclusion: The impugned order was set aside and the assessee succeeded in the appeal.
Ratio Decidendi: Classification must be determined on the basis of the product's technical characteristics, commercial understanding and the relevant tariff notes, and cannot be altered merely on personal opinion without supporting expert evidence.
