Issues: Whether the appeal challenging disposal of the SCORES complaint and seeking monetary compensation and regulatory action was maintainable, and whether any ground existed to interfere with the impugned disposal in view of the delay and the available grievance-redress mechanism.
Analysis: The reliefs sought were in the nature of a civil claim for compensation and reimbursement, which could not be adjudicated in this Tribunal. The appellant had already invoked the SCORES mechanism and, if dissatisfied with the outcome, ought to have pursued the further remedy of review available under the SEBI grievance framework. The appeal was also brought after a substantial lapse of time, and no sufficient basis was shown to disturb the impugned disposal.
Conclusion: The appeal was not maintainable to the extent it sought civil monetary reliefs, and no case for interference on merits or delay was made out.
