                          Capital work-in-progress expenditure for unsuccessful mines allowed as revenue deduction, interest from sick subsidiary not taxable

                          ITAT Hyderabad allowed the assessee's appeals on multiple grounds. Capital work-in-progress expenditure for unsuccessful/closed mines was held to be revenue expenditure and allowed as deduction. Interest receivable from a sick subsidiary company declared by BIFR was not taxable on accrual basis due to uncertainty of receipt. Prior period expenditure was allowed in the year it crystallized.                           Detailed Analysis:

                          1. Disallowance of Capital Work-in-Progress:
                          The assessee had debited Rs. 4.24 crores towards ‘assets written off’ under ‘provisions and write off’ in the P&L Account. The AO disallowed Rs. 14,54,302/- as it did not represent an allowable deduction. The CIT(A) confirmed this disallowance. The ITAT, however, found that the expenditure was of a revenue nature and incurred wholly and exclusively for business purposes. The ITAT relied on various judgments, including CIT vs. Binani Cements Ltd., and concluded that the expenditure should be allowed as it did not bring any additional advantage to the business.
