The AO allowed depreciation at 10%, treating the assets as 'building', whereas the assessee claimed 15% depreciation, classifying them as plant and machinery. The CIT(A) upheld the AO’s decision, following earlier years' rulings. The ITAT referred to its decision in the assessee's own case for AY 2011-12, where it was held that expenditures incurred for mine development should be treated as plant and machinery, given their functional nature in the coal mining business.
