Issues: Whether the quota for direct recruitment under the special service rules was to be worked out against the existing vacancies or on the basis of the cadre strength, and whether the later general-rule amendment controlled the special rules.
Analysis: The service rules for the cadre provided that every fourth substantive vacancy was to be filled or reserved for direct recruitment. The general rules, as amended by Note (3) to Rule 5, required that where a ratio or percentage is fixed, the number of vacancies for each method of recruitment must be determined by applying that ratio to the cadre strength and not to the vacancies existing at the time. The later amendment was made under the Kerala Public Services Act, 1968, and the existing general rules were saved under that Act. Reading the two sets of rules together, the method prescribed in the special rules was not repugnant to the general rules. The proper interpretation was that the 25:75 ratio had to be maintained with reference to the entire cadre strength so that the quota was not distorted by vacancy-based recruitment.
Conclusion: The quota for direct recruitment had to be determined on the basis of cadre strength, not existing vacancies, and the challenge to the recruitment pattern failed.
Ratio Decidendi: Where special service rules fix a recruitment ratio and a later general-rule amendment expressly requires that the ratio be applied to cadre strength, the rules must be read harmoniously and the quota is computed with reference to cadre strength rather than existing vacancies.
