Analysis: The challenge concerned an order under Section 482 of the Code of Criminal Procedure, 1973 by which the High Court, without recording findings on the charge-sheet or on the necessity for further investigation, sought assistance from a senior police officer and effectively stalled the trial. The Court held that once investigation had been completed and the charge-sheet filed, the proper course was for the Court to examine whether any case for further investigation under Section 173(8) of the Code of Criminal Procedure, 1973 was made out. A direction for reinvestigation by another agency could not be issued merely because of an asserted lack of supervision by higher police officers or on an unreasoned impression that the investigation might have been imperfect. The accused's repeated attempts to avoid arrest and to stall proceedings also undermined the bona fides of the application.
Conclusion: The High Court was not justified in directing reinvestigation or in staying the proceedings, and its order was set aside in favour of the appellant.
Ratio Decidendi: After completion of investigation and filing of the charge-sheet, a court cannot direct reinvestigation or stall criminal proceedings in the absence of recorded justification; at most, it may consider lawful further investigation under Section 173(8) of the Code of Criminal Procedure, 1973.
