Issues: Whether omission to forward the forensic report along with the charge-sheet made the police report invalid and entitled the accused to statutory bail under section 167(2) of the Code of Criminal Procedure, 1973.
Analysis: Section 173(5) requires forwarding of documents and statements on which the prosecution proposes to rely, but the absence of a particular report does not necessarily vitiate the police report if the charge-sheet is otherwise filed within time on the basis of available materials. The charge-sheet in this case was submitted within the statutory period, accepted by the Magistrate, and cognizance was taken. The possibility of forwarding additional material through further investigation under section 173(8) also shows that later receipt of evidence does not render the earlier police report non-existent or invalid. The omission of the forensic report therefore did not justify treating the charge-sheet as ineffective for purposes of statutory bail.
