Waiver of pre deposit - held that:- In view of the orders passed by a learned Single Judge of the Kerala High Court in the case titled M/s Muthoot Finance Ltd. Vs Union of India and another, [2015 (3) TMI 634 - KERALA HIGH COURT], the respondents shall not treat the appeal as being not maintainable on account of the failure to deposit the amounts as per the amended Section 35-F of the Central Excise Act, 1944 which came into effect on 06.08.2014. The Punjab and Haryana High Court issued a notice of motion to the respondents returnable on 29.06.2015. The petitioners sought a stay of the pre-deposit, citing a case from the Kerala High Court regarding the deposit amount under the Central Excise Act. The court clarified that their order did not stay the demand, but allowed the petitioners to apply for interim relief based on previous provisions. The Tribunal could decide on granting a conditional stay.
