Analysis: The land was situated in a developing town where nearby plots had fetched a higher price, municipal witness evidence of sale value remained unchallenged, and the surrounding area had shown commercial and building development. In estimating compensation, a deduction for the undeveloped nature of the area could be made, but the lower courts had adopted a rate that did not reflect the true value of the land or its potential for development.
Conclusion: The compensation was enhanced from Rs. 2 per sq. yard to Rs. 10 per sq. yard, with proportionate increase in interest and solatium, in favour of the appellant.
