Issues: Whether, at the interim stage, full waiver of pre-deposit and stay of recovery could be granted in respect of duty demanded on imported palm oil classified as non-edible grade.
Analysis: The classification dispute turned on Chapter Supplementary Note No. 1 of Chapter 15 of the Customs Tariff Act, 1975, which links edible grade determination to Appendix B of the Prevention of Food Adulteration Rules, 1955. The relevant standard required an acid value not exceeding 6.0, while the chemical examination referred to in the order showed higher values and indicated adulteration. On that basis, the goods were not shown, at the prima facie stage, to be pure edible grade palm oil. The claim that the goods were cleared through the Public Distribution System and that the exemption notifications applied was left for detailed examination at the final hearing. Considering the overall facts, the order granted only partial relief by directing a substantial pre-deposit and staying recovery of the balance during pendency of the appeal.
Conclusion: Full waiver was declined, but partial waiver of pre-deposit was granted with stay of recovery on compliance.
