Issues: Whether man-made grey fabrics dealt with by a registered dealer retained the character of inputs for the purpose of Cenvat credit under Notification No. 35/03 dated 10th April, 2003, and whether the dealer could be denied credit on the footing that the goods were not inputs in its own hands.
Analysis: The expression "input" was treated as a relative concept, because a finished product for one person may be an input for another. Grey fabrics were finished goods for the manufacturer, but they were inputs for the processor who used them for further processing. The introduction of a dealer in the chain did not change the character of the goods as inputs, especially when the notification itself contemplated credit in respect of stock with traders as well as stock with processors. The reference to Rule 2(g) of the Cenvat Credit Rules, 2002 did not justify treating the goods as something other than inputs in this context, and the penal provision invoked under Rule 13 also proceeded on misuse of credit on inputs.
Conclusion: The goods were to be treated as inputs in the hands of the dealer for the purpose of the notification, and the denial of credit was not sustainable.
Final Conclusion: The appeals succeeded and the appellants obtained the claimed Cenvat credit treatment on the disputed grey fabrics.
Ratio Decidendi: For Cenvat credit purposes, the character of goods as inputs depends on their role in the relevant chain of use, and the interposition of a dealer does not by itself alter that character where the goods remain inputs for the next user.
