      Corrigendum - Notification No. G.S.R. 776(E), dated the 11th October, 2019
      Summary: Corrigendum directs that in the earlier Gazette notification the phrase "Defence Research and Development Organisation (DRDO)" be read as "Defence Research and Development Organisation (DRDO), Department of Biotechnology (DBT)", thereby adding the Department of Biotechnology to the notified entry; issued by the Ministry of Corporate Affairs as a textual correction with the stated file reference.

      Summary: Corrigendum issues four textual corrections to State Tax (Rate) notifications: replace "Section 9" with "Section 11"; insert "of the United Nations (FAO)" after "Agricultural Organization"; read "with" for "without" in the affected provision; and correct the figures "2019" to "2018", with each amendment identified by notification number, Gazette page and line.

      50/2019-State Tax - dated - 14-11-2019 - Himachal Pradesh SGST
      Amendment in the Notification of the Government of Himachal Pradesh No. 21/2019- State Tax, dated the 30th May, 2019.
      Summary: An amendment inserts a proviso into paragraph 2 of Notification No. 21/2019-State Tax, specifying that the due date for furnishing the statement containing details of payment of self-assessed tax in FORM GST CMP-08 for the quarter July-September 2019, or part thereof, shall be the 22nd day of October, 2019. This notification comes into force with effect from the 18th day of October, 2019.

      49/2019-State Tax - dated - 1-11-2019 - Himachal Pradesh SGST
      The Himachal Pradesh Goods and Services Tax (Sixth Amendment) Rules, 2019.
      Summary: Amendments clarify that during suspension of registration no tax invoices shall be issued or tax charged, and on revocation suppliers must comply with invoicing provisions of section 31(3)(a) and section 40 for supplies made during suspension. They also limit input tax credit for invoices or debit notes not uploaded by suppliers under section 37(1) to not exceed 20% of eligible credit evidenced by uploaded details.

      47/2019-State Tax - dated - 1-11-2019 - Himachal Pradesh SGST
      Notify the registered persons whose aggregate turnover in a financial year does not exceed two crore rupees and who have not furnished the annual return.
      Summary: Notification classifies registered persons with aggregate turnover not exceeding the turnover threshold who have not furnished the statutory annual return before the due date as eligible to follow a special procedure to furnish annual returns for the financial years 2017-18 and 2018-19, and provides that where the annual return has not been furnished before the due date it shall be deemed to be furnished on the due date.

      Extends the time limit for furnishing the details of outward supplies in FORM GSTR-1 registered persons having aggregate turnover of more than 1.5 crore rupees.
      Summary: Extends the deadline for furnishing details of outward supplies in FORM GSTR-1 by registered persons having aggregate turnover of more than 1.5 crore rupees in the preceding financial year or the current financial year, for each month from October 2019 to March 2020, until the eleventh day of the month succeeding such month; the extension is issued by the Commissioner under the second proviso to sub section (1) of section 37 read with section 168 of the Himachal Pradesh GST Act, 2017. The time limit under sub section (2) of section 38 for those months will be notified later.

      Notify the registered persons having aggregate turnover of up to 1.5 crore rupees in the special procedure as mentioned below for furnishing the details of outward supply of goods or services.
      Summary: Notification designates registered persons with aggregate turnover up to the specified small taxpayer threshold to follow a special procedure and mandates furnishing details of outward supply of goods or services in FORM GSTR-1 for the quarter in which supplies are effected; filing timelines for the October-December quarter and the January-March quarter are prescribed, and the time limit for furnishing details or returns for October through March will be notified subsequently in the Official Gazette.

      Payment of taxes for discharge of tax liability as per FORM GSTR-3B.
      Summary: Registered persons must file FORM GSTR-3B electronically through the common portal by the stated monthly due date and discharge tax, interest, penalty, fees or other amounts payable by debiting the electronic cash ledger or electronic credit ledger, as applicable, not later than that filing due date, in accordance with the statutory payment provisions.

      Collection and reporting of margins by Trading Member (TM) /Clearing Member (CM) in Cash Segment
      Summary: Trading Members and Clearing Members in the cash segment must collect VaR margins and Extreme Loss Margin (ELM) upfront from clients; other margins must be collected promptly within a short prescribed window. Institutional investor exemptions and an exception where adequate initial margins already cover potential losses are preserved. TMs/CMs must report actual short-collection or non-collection of client margins to the stock exchange within the prescribed reporting timeframe, and stock exchanges must apply disciplinary frameworks for short-collection and for false or incorrect reporting.

      Incorrect Data in certain IECs - corrective action required from exporters
      Summary: IECs with incorrect PAN or where multiple IECs exist against the same PAN must be corrected by written application to the jurisdictional RA: incorrect PANs require a letter on IEC letterhead with a self certified PAN copy (changes not permitted via the online module); duplicate IECs require separate written requests to suspend/cancel other IECs, with RAs to take action after due diligence and to suspend multiple IECs if no holder request is received, permitting reactivation only on written request with required documents. Representations or personal hearings may be submitted if correction cannot be completed before the deadline.
